Remember when the Kardashians came to Capitol Hill?

The House Oversight Committee is holding a hearing today on carcinogens in consumer products and FDA’s regulation of these products. Looks like cosmetic reform is back in on Capitol Hill.

Have no idea what I’m talking about? May I suggest you check out Nov. 25th’s episode of everyone’s favorite reality TV show, Keeping Up With The Kardashians? The episode features none other than New Jersey’s native son Rep. Frank Pallone, who has been calling for greater regulation of cosmetics since at least 2016. The effort has fizzled in the past, but Pallone is back at it: He’s in the process of circulating a new draft bill that would drastically revamp how FDA regulates the industry. And as chairman of the Energy & Commerce Committee, he’s arguably in the best space he’s ever been to get the effort across the finish line.

The 104-page bill, which was shared with STAT, would require cosmetic manufacturers to register with FDA, to submit to a list of all ingredients in a product, and to attest that the ingredients are safe. Products that aren’t properly registered would be blocked from the market. The bill would also give FDA the ability to shut down cosmetic manufacturers suspected of marketing unsafe products, and would direct FDA to review a number of cosmetic ingredients each year.
 
(And in case you’re curious how the law defines a cosmetic...Behold, my all-time favorite regulatory definition: The Food Drug & Cosmetic Act defines a cosmetic as "articles intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body...for cleansing, beautifying, promoting attractiveness, or altering the appearance.” Kudos to the staffer who wrote that one.)
