Bloomberg wants to blow up the patent system
Presidential hopeful Mike Bloomberg announced Monday that he wants to block drug makers from getting more than one patent on their drug. It’s an extreme solution to the issues of ‘patent thickets’ and ‘evergreening,’ where drug makers amass countless patents to block generic competition for seemingly forever.
The idea doesn’t just prevent bad behavior. It would totally shake up the entire drug patent landscape.
Patent reform advocates say that’s exactly what the doctor ordered.
“That’s the only way you can move the conversation,” said Tahir Amin, the co-founder of I-MAK, a patent reform group that focuses on drug prices. “You have to make this kind of leap to get people to start thinking differently.”
The drug industry, however, tells a very different story. Brian Newell, a spokesperson for BIO, said the idea “would devastate the development of new treatments.”
Some were even more blunt: “I would expect the founder of such an innovative company to appreciate the absurdity of capping innovation in one of the country’s most cutting-edge industries. Mayor Mike always struck me as a thoughtful politician, but parts of this plan feel more like pandering,” said Patrick O’Connor, the executive director of the Alliance to Protect Medical Innovation, a drug-industry aligned advocacy group.
