Supreme Court denies Democratic-led states’ request for an expedited ACA review
The Supreme Court said yesterday that it wouldn’t fast-track its review of a lower court ruling that declared parts of the Affordable Care Act unconstitutional. Earlier this month, a coalition of 20 states led by California Attorney General Xavier Becerra requested an expedited review of the Fifth Circuit Court of Appeals’ ruling declaring the individual mandate in the ACA unconstitutional. The coalition contested the ruling, and was hoping for a review before the presidential election this November, arguing that the consequences of the case are too important and far-reaching to be decided by a lower court and over several months. At the same time, the Supreme Court did not rule out considering the appeal to the Fifth Circuit Court’s ruling, although it’s unclear when that decision will be made.
