Pharma companies sue over policy requiring drug prices in TV ads 

Amgen, Merck, and Eli Lilly — joined by the Association of National Advertisers — are suing the Trump administration over its policy requiring drug makers to include list prices in TV ads. The administration says that requiring companies to be transparent about pricing will lead to lower drug costs. In a statement, Amgen said that the rule, which is set to go into effect this summer, raises “freedom of speech concerns” and that it “fails to account for differences among insurance, treatments, and patients themselves.” The companies and some legal experts also argue that the rule would mislead patients about their actual out-of-pocket costs and therefore not allow them to make truly informed choices about the drugs they choose to take.
