Ten Year Review of the NIOSH Radiation Dose Evaluation Program-Phase I Report
2010 marked the tenth anniversary of the passage of the Energy Employees Occupational Illness Compensation Program Act (EEOICPA) of 2000. Under the provisions of EEOICPA, the President delegated to the Secretary of the Department of Health and Human Services (HHS) the tasks of performing individual dose reconstructions (DRs) and evaluating petitions for additions to the Special Exposure Cohort (SEC). As of December 31, 2010, NIOSH has completed 27,832 individual dose reconstructions and has received for consideration 182 SEC petitions.
Given the passage of ten years and the considerable amount of work that has been accomplished by the National Institute for Occupational Safety and Health (NIOSH) in support of EEOICPA, the NIOSH Director commissioned a ten year retrospective review of NIOSH’s efforts. Such a review is consistent with the recently completed reviews of eight major NIOSH research programs of the National Academies.

The review of the NIOSH Program in support of EEOICPA—and the NIOSH Division of Compensation Analysis and Support (DCAS)-will focus upon the following five areas:
1.The quality of science practiced in the program at the current time as well as throughout the evolution of the program (Quality of Science). 3.The appropriateness and the consistency of decisions regarding petitions to add groups of claimants to the Special Exposure Cohort established under the statute (Special Exposure Cohort). Author: Randy Rabinowitz, CDC/NIOSH contractor.

By design, the review will involve two distinct phases for each of the five review areas. Phase I is a data driven assessment of program activities in the area in question. This document is the Phase I Final Report. The Phase I area reports will conclude with the presentation of observations and conclusions that can directly be drawn from the materials presented.
Phase II will build upon the foundation of the Phase I Report and conclude with recommended changes in the NIOSH Program in support of EEOICPA.
Phase I area reports were authored by NIOSH employees and CDC/NIOSH contractors who are familiar with NIOSH’s activities, but not directly involved in the supervision of those activities. Phase II will be undertaken by a team of NIOSH senior leaders under the direction of the NIOSH Director.
The reader should be aware that there is obvious overlap between the five, Phase I area reports. For example, the Dose Reconstruction review will touch upon timing as will the Customer Service review. No attempt was made to eliminate of minimize such overlap as it was felt that the observations of each of the authors would add diversity and substance to the overall report. In some instances, there is duplication between the contents of several Phase I area reports with overlapping authorship. No attempt was made to eliminate such duplication as the information duplicated is considered to be important to totality of both Phase I area reports.
The Phase I area reports were provided to the Advisory Board on Radiation and Worker Health (ABRWH) and posted on a publically available website. A public docket was established to receive comments on the overall Program Review, as well as the posted Phase I area reports. The NIOSH review process is different for reports authored by CDC/NIOSH contractors versus NIOSH employees. Therefore the timing of the initial posting of the Phase I reports varied.
